1. Introduction

Welcome to EasyConsent ("Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the EasyConsent platform, including our website, software, and related services.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Account Registration

To use certain features of our Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all risks of unauthorized access to your account
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Free Trial Period

New accounts receive a 14-day free trial period. During this period:

• You have full access to the features included in your selected plan
• No payment is required during the trial period
• You may cancel at any time without being charged
• After the trial ends, your subscription will automatically begin unless cancelled

We will send you a reminder email 3 days before your trial ends. If you do not wish to continue after the trial, you must cancel before the trial period expires.

4. Billing and Payment

4.1 Subscription Plans: We offer multiple subscription plans with different features and pricing. Current plans and pricing are available on our pricing page.

4.2 Billing Cycle: Subscriptions are billed monthly on the anniversary of your subscription start date. You authorize us to charge your payment method on file for all subscription fees.

4.3 Payment Methods: We accept payments via credit card and other methods processed through Stripe. You must provide valid payment information and keep it current.

4.4 Failed Payments: If payment fails, we will attempt to charge your payment method again. If payment continues to fail, we may suspend or terminate your account.

4.5 Taxes: All prices are exclusive of applicable taxes, which will be added to your invoice where required by law.

5. Cancellation and Refunds

5.1 Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

5.2 Access After Cancellation: After cancellation, you will retain access to the Service until the end of your current billing period. After that, your account will be downgraded to a free tier (if available) or suspended.

5.3 Refunds: Subscription fees are non-refundable except as required by law or as expressly stated in these Terms. We do not provide refunds for partial months of service.

5.4 Trial Cancellation: If you cancel during your free trial period, you will not be charged.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit malicious code or compromise system security
• Engage in unauthorized access or data scraping
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal or unauthorized purpose
• Resell or redistribute the Service without authorization

We reserve the right to investigate and take appropriate action against anyone who violates this provision, including removing content, suspending or terminating accounts, and reporting to law enforcement.

7. Data and Privacy

7.1 Your Data: You retain all rights to data you submit to the Service. We do not claim ownership of your content or data.

7.2 GDPR Compliance: We process personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy laws. See our Privacy Policy for details.

7.3 Data Processing: By using our Service, you authorize us to process data necessary to provide the Service, including consent logs, analytics, and related information.

7.4 Data Retention: We retain your data as described in our Privacy Policy. Upon account termination, we will delete or anonymize your data according to our data retention policy.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by EasyConsent and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. This license does not include any resale or commercial use of the Service or its contents.

9. Service Availability

9.1 Uptime: While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9.2 Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

9.3 Support: We provide email support to all paid subscribers. Response times vary by plan level.

10. Limitation of Liability

To the maximum extent permitted by law, EasyConsent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses resulting from:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the Service
• Any other matter relating to the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

12. Indemnification

You agree to indemnify and hold harmless EasyConsent and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or violation of any rights of another party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Sweden.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by email or through a notice on the Service.

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.
